Background: The American Rescue Plan Act (ARPA) of 2021 was put into law on March 11, 2021 to provide stimulus funds to help with recovery from the economic and health effects of the COVID-19 pandemic. Included in the plan is another round of the Elementary and Secondary School Emergency Relief Fund (ESSER III) to districts to help safely reopen, sustain operation of schools, and address the impact of COVID-19 on elementary and secondary schools.

ESSER III funding provides districts considerable flexibility in determining how best to use the funds. Ninety percent of the funds the State receives is to be allocated by the same formula used to distribute Title I Part A of the Elementary and Secondary Education Act funds. The term of available funding for the ESSER III grant program is March 13, 2020 through September 30, 2024.

The following are ESSER III requirements for school districts:
• Set aside twenty percent of funding to address learning loss through the implementation of evidence-based interventions and ensure that those interventions respond to students’ social, emotional, and academic needs and address the disproportionate impact of COVID-19 on underrepresented student subgroups (each major racial and ethnic group, children from low-income families, children with disabilities, English learners, gender, migrant students, students experiencing homelessness, and children and youth in foster care)
• Engage in meaningful consultation with stakeholders in the development of the ESSER III district plan
• Develop and make publicly available on the website a plan for a safe return to in-person instruction and continuity of services
• Meet local maintenance of equity requirements for fiscal years 2022 and 2023

Fiscal Impact Statement: The tentative allocation for Milwaukee Public Schools (MPS) is $505,767,416 in ESSER III funding. MPS awaits further details from the state on the ESSER III application timeline. This item does not authorize expenditures.
Implementation and Assessment Plan The district will move forward with developing a plan in consultation with key stakeholders including but not limited to students, families, teachers, school leaders, administrators and others. The plan will be presented to the Milwaukee Board of School Directors to seek further input from the Board and community members.
